ACCEPTANCE TERMS

Our website has a form that customers and clients can use to contact us. Whenever you click a button on a website or check a box, you are agreeing to the terms. Agnipay offers this option in its user interface. You must agree to the terms in order to use the offering. If you don't accept the terms, you can't use it.

Agnipay PROVIDES THE SERVICE

By using our online, digitally enabled payment service, you can accept online payments from credit cards, debit cards, and other types of cards. To access the offering, you need a bank account. It will continue to provide its users with the best possible service by providing APIs and other software. APIs and other software are provided by Agnipay.

You may not be able to access your account details, files, or other content contained in your account if Agnipay disables access to your account. Agnipay does not currently restrict your use of the offering, but it may in the future if your use interferes with its ability to operate or if it prevents other customers from using it. Agnipay is not responsible for any loss or damage resulting from changes to the features, limitations in the use of the offering, or its discontinuation.

Agnipay is not responsible for determining whether any taxes apply to a merchant's goods and services and/or payments received in connection with the merchant's use of the Agnipay Service ("Taxes").

Tax assessments, collections, reporting, and remittance are solely the responsibility of merchants. Agnipay is not responsible for determining whether taxes are applicable or for calculating, collecting, reporting, or remitting them.

ADVANCED USER OFFERS

In order to register for a service or continue using the service, you may have to provide your personal information. Agnipay requires accurate, complete, and up-to-date registration information.

A transaction is authenticated and processed by you alone, and the information and data collected are your sole responsibility. There is no liability on the part of Agnipay. Customer information may be shared with the government or law enforcement agencies with the consent of the customer or client (if they receive an official request or are required to do so by law).

Agnipay will not allow you to access the offering by any means other than the interface provided by Agnipay, unless Agnipay explicitly permits this. Please do not interfere with or disrupt the offering (or the servers and networks that are connected to it).

(URL) does not permit the copying, selling, trading, or reselling of this offering without a separate agreement.

Agnipay is not responsible for any breach of your obligations under these terms, nor for any consequences (including any loss or damage that Agnipay may suffer).

YOUR ACCOUNT SECURITY

All activities under your account are your sole responsibility. A card transaction that does not relate to a sale of goods or services cannot be submitted for processing. When storing or transmitting card data, you will use only PCI-compliant service providers. If you become aware of any unauthorized use of your password or account, you agree to notify Agnipay immediately. Whenever you store or transmit cardholder data, such as an account number, expiration date, or CVV2, you must use a PCI-compliant provider.

INTERNET PROPERTY RIGHTS

All legal rights, title, and interest to Agnipay (or Agnipay's licensors) are owned by Agnipay (or Agnipay's licensors), including intellectual property rights (whether those rights happen to be registered or not, and wherever in the world they may exist), and you are only a licensee. You acknowledge and agree that the offering may contain information Agnipay has marked as confidential, and that you will not share this information without written permission from Agnipay.

DISCLAIMER OF WARRANTIES

YOU AGREE TO USE THE OFFERING AT YOUR OWN RISK. WE PROVIDE THE OFFERING AS IS AND AS AVAILABLE AT YOUR SOLE RISK.

Agnipay DOES NOT MAKE ANY REPRESENTATION OR WARRANTY:

YOU WILL RECEIVE AN OFFER THAT MEETS YOUR REQUIREMENTS, IS UNINTERRUPTED, TIMELY, SECURE, AND FREE OF ERRORS, INCLUDING SERVER DOWNTIME.

Agnipay DISCLAIMS ALL IMPLIED WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

LIABILITY LIMITATION

Agnipay Disclaims All Liability:

• We consider direct, indirect, incidental, consequential, or exempt damages regardless of the cause or the legal theory. A loss of profit (regardless of the type of loss), a loss of goodwill, a loss of reputation, a loss of data, the cost of procuring substitute goods or
• The following losses or damages have been suffered by you:
• It is possible Agnipay may change or discontinue the offering (or any feature within the offering);
• Any deletion, corruption, or unstoppable storing of contents or communications data managed or transmitted by the offering;
• Agnipay does not receive accurate account data;
• The details of a customer's account and their passwords are not confidential;

INHERENT SEVERABILITY

Any part of the Terms and Conditions or portions thereof that is invalid, illegal, or unenforceable is only void, invalid, illegal or unenforceable if that part of the Affected Provision is deemed invalid, illegal or unenforceable by the law to which they are subject or by a court of competent jurisdiction (“Affected Provisions”). The enforceability of the remaining Affected Provisions and other Terms and Conditions will not be affected by that portion.

TERMS CHANGE

Agnipay may update the terms at any time. You will be notified by email of the same on Agnipay website and will need to approve it within 10 days. You will be able to access the changes made by Agnipay. If you use the offering after the amended terms become effective, or after the deadline for responding has passed, you are considered to have accepted the amended terms.
